HIPAA Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Bing Counseling is operated by Gregory Bing, MA, LPC, a Licensed Professional Counselor licensed in New Jersey (licence #37PC01088300). This notice applies to all records of your care created or held by this practice.

My obligations

I am required by law to:

  • keep your protected health information private;
  • give you this notice describing my legal duties and privacy practices;
  • follow the terms of the notice currently in effect; and
  • notify you if a breach affects your unsecured protected health information.

How your information may be used and disclosed

Treatment

Information may be used to provide and coordinate your care — for example, with your written authorisation, consulting with your physician or a prescriber about your treatment.

Payment

If you use insurance, the minimum information needed to obtain payment may be shared with your plan: dates of service, diagnosis and procedure codes, and, where the plan requires it, treatment information for authorisation. If you pay privately, this does not apply.

Health care operations

A limited amount of information may be used for the practice's own quality, administrative and compliance activities.

Uses and disclosures that require your written authorisation

Most uses of psychotherapy notes, any use for marketing, and any sale of your information require your written authorisation. You may revoke an authorisation in writing at any time, other than for actions already taken in reliance on it.

Uses and disclosures permitted or required without your authorisation

In specific, legally defined circumstances, information may be used or disclosed without your authorisation. These circumstances are narrow, and I will discuss them with you at the start of our work so you know where the boundaries of confidentiality are before you decide what to share. They include:

  • Serious threat to health or safety — where disclosure is necessary to prevent or lessen a serious and imminent threat to you or to an identifiable person.
  • Suspected abuse or neglect — where New Jersey law requires a report concerning a child, or a vulnerable or elderly adult.
  • Legal proceedings and law enforcement — in response to a court order or other lawful process, where I am compelled to respond.
  • Health oversight and public health activities — as required by law.
  • Workers' compensation — as authorised by law, where a claim applies.

Your rights

  • Inspect and copy your record, with limited exceptions. Psychotherapy notes are treated differently from the rest of the record.
  • Request an amendment if you believe information is incorrect or incomplete.
  • Request an accounting of certain disclosures made in the past six years.
  • Request restrictions on how information is used or shared. If you pay in full out of pocket for a service, you may restrict disclosure of that service to your health plan.
  • Request confidential communications — for example, that I contact you only by a particular method or at a particular number.
  • Request a paper or electronic copy of this notice at any time.
  • Choose someone to act for you — a legal guardian or someone holding a medical power of attorney may exercise these rights on your behalf.

Telehealth

Sessions take place by video. A platform that supports HIPAA-required safeguards is used, under a business associate agreement. Please join from somewhere private — the confidentiality of your own physical location is something only you can control.

Complaints

If you believe your privacy rights have been violated, you may raise it with me directly using the details on the contact page, or file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be penalised or treated differently for filing a complaint.

Changes to this notice

I may change this notice, and the revised notice will apply to information already held as well as to information created afterwards. The current version is always posted on this page.
